Regulations of apduro.pl online store

1. General information.
1.1 The owner and operator of the online store operating at www.apduro.pl is Alu Pro Andrzej Kowalczyk based at 12 Kazimierza Wielkiego Street, 34-143 Lanckorona, Tax Identification Number PL 5512519601, Business Regon 361979955.
1.2 These Regulations have been drawn up on the basis of regulations binding in the Republic of Poland and define the rules of operation of the apduro.pl Internet Store operating under the domain www.apduro.pl, provision and use of services by Alu Pro Andrzej Kowalczyk, operating under the brand name Apduro. The Rules define the rights and obligations of Users and Customers, as well as the rights, obligations and responsibilities of Alu Pro Andrzej Kowalczyk - the entity managing and operating the Internet Store.
 

2 Definitions.
The terms used in these Regulations shall mean:

2.1 Regulations - this document available at www.apduro.pl/regulamin defining the rules for the conclusion and performance of Contracts and Sales Agreements and constituting an integral part of these agreements;

2.2. Alu Pro - the company Alu Pro Andrzej Kowalczyk, based in Lanckorona, referred to in point 1.1 above;

2.3 Online Store - Internet transaction service operated by Alu Pro and available under the domain www.apduro.pl, where Products for sale are presented and Sales Agreements are concluded between Customers and Alu Pro;

2.4 User - a natural person who has full or, subject to the consent of the statutory representative to the conclusion of the Agreement, limited capacity to perform legal acts under the applicable law, who by making a proper Registration at the online store www.apduro.pl has concluded an Agreement with Alu Pro, as a result of which an Account assigned to him/her has been created;

2.5. Account - computer record maintained free of charge for the User by Alu Pro, in which Personal Data of the User and information about his/her actions within the framework of the Online Store apduro.pl are collected. Access to the Account allows respectively:
(a) User - identification in the Online Store apduro.pl ;
(b) Customer - making Offers for the Product chosen by the Customer;

2.6. Customer - User entitled to submit Offers not directly connected with his business or professional activity, being a consumer within the meaning of the provisions of the Act of 23.04.1964 Civil Code and a party to the Sales Agreement;

2.7 Offer - an offer to conclude a Sales Agreement made to Alu Pro by the Customer, understood in accordance with the provisions of the Civil Code Act of 23.04.1964;

2.8 Sales Campaign - information placed in the Online Store concerning the presented Products which can be purchased by the Customer as a result of an Offer placed by the Customer and subsequently accepted by Alu Pro. The presentation of the Products is subject to change and does not constitute an offer within the meaning of the Civil Code;

2.9 Product - a product that is the subject of a Sales Agreement. Products are presented in the online store apduro.pl within the Sales Campaign, are manufactured by Alu Pro or come directly from manufacturers, are original and branded products and constitute high quality motorcycle accessories;

2.10. Agreement - agreement for the provision of services by electronic means entered into voluntarily by the User with Alu Pro upon confirmation of Registration, in accordance with clause 4.7 of the Regulations;

2.11. Sales Agreement - contract of sale of the Products indicated in the Offer, concluded between Alu Pro and the Customer under the conditions specified in the Terms of Use;

2.12. Registration - the procedure specified in item 4.3 of the Regulations, leading to the creation of an Account that allows the identification of the User while using the Online Store apduro.pl on the basis of a login, which is a sequence of unique characters;

2.13. Personal Data - information collected during the Registration process concerning the Customer as an identified or identifiable natural person, processed by Alu Pro to the extent necessary to establish, shape the contents of a Sales Agreement, change, terminate and properly perform the above mentioned agreements, make settlements with the Customer, for direct marketing of its own Products, as well as for other purposes provided that appropriate consents have been obtained;

2.14. Shopping Cart - IT tool available on the apduro.pl Online Store that allows the Customers to place Offers for selected Products, and then a single confirmation of independently placed Offers in the form of an order;

2.15. Selling Price - the price of Product sale by Alu Pro to the Customer, determined on the basis of information provided within a Sales Campaign from the moment of placing an Offer by the Customer. The Selling Price stated in the Sales Campaign includes taxes and all fees required by the applicable law, excluding transport costs;


3 Technical conditions of use of the online store.
3.1 The operation of the Online Store by Alu Pro primarily includes the following functions and services:
(a) access to the transactional platform, inter alia through the maintenance and administration by Alu Pro of User Accounts, enabling Customers to submit Offers for the purchase of Products presented as part of a Sales Campaign;
(b) provision of server space by Alu Pro in order for Users to place therein the data which serve to identify them and to conclude Contracts and Sales Agreements.

3.2 In order to use the On-line store, it is necessary for the User to have a device that allows access to the Internet, including a program used to browse its resources.

3.3 In connection with the use of services provided by Alu Pro electronically under the Agreement, the User is bound by the prohibition of illegal content.


4 Principles of using the online store.
4.1 Alu Pro presents the Products for sale via the Internet (on-line). Information about the Products are placed on the website www.apduro.pl and only Users have the possibility to purchase them.

4.2 The creation and use of an Account in the online store is voluntary and free of charge within the scope of services provided by Alu Pro.

4.3 The Registration procedure consists in completing the registration form available at www.apduro.pl and accepting these Regulations.

4.4 Acceptance of the Regulations by the User is equivalent to making the following statements:
(a) I have read the Regulations and accept all of their provisions;
(b) I voluntarily joined the services of the Internet Shop apduro.pl;
(c) Personal data contained in the registration form, as may be amended during the use of the Online Store, are true, lawful and do not violate the rights of third parties.

4.5 The User agrees to provide truthful Personal Data in the registration form: name, surname, e-mail address (except so-called temporary e-mail addresses) and the password.

4.6 After completing and confirming the truthfulness of Personal Data in the registration form, a message will be sent to the email address provided in the form, indicating how to confirm the Registration. The moment the Registration is confirmed, a Contract is concluded between the User and Alu Pro for an indefinite period of time, the object of which is access to services provided by Alu Pro.

4.7 As a result of a correct Registration, Alu Pro creates for the User an Account assigned to the email address and password submitted in the registration form. The User obtains access to an Account after confirming the submitted e-mail address and password (login).

4.8 The Account contains in particular the Personal Data of the User provided by him in the registration form. If any of this Personal Data changes later, the User shall immediately update it using the appropriate form available in the Online Shop.

4.9 The Account User is not entitled to include in the registration form Personal Data of third parties and images of third parties without the required legal permission or consent of that third party.

4.10. It is forbidden for the User to delete the Personal Data referred to in item. 4.10. The User is not allowed to delete the Personal Data referred to in item 4.5 of the Terms of Use while using Alu Pro's services, nor to provide incomplete, outdated or false Personal Data.

4.11. The User may not have more than one Account assigned to one e-mail address.

4.12. The User may terminate the Agreement concluded with Alu Pro (concerning a particular Account) without indicating the reason, observing the 7-day notice period, by sending an e-mail to alupro.biuro@gmail.com with the subject "RESIGNATION".

4.13. For important reasons (including in relation to changes in the law, the User's actions deemed detrimental to the Online Store, violation by the User of the provisions of these Regulations) an Agreement concluded by the User with Alu Pro (concerning a specific Account) may be terminated by Alu Pro with a 7-day notice.

4.14 If the Contract has been terminated by Alu Pro, the User may not register again without the prior consent of Alu Pro.

4.15. In the cases specified in sec. 4.12 and 4.13 of the Terms, Alu Pro shall delete the User's Account. As a result of deleting the Account, all Personal Data of the User entered under the Account will be irrevocably deleted. Alu Pro reserves the right to retain the personal data entered by the User within the Account for the purpose of asserting any claims related to the use of the Online Store by the User, making such personal data available to the competent authorities, and in other legally regulated cases.


5 Principles of concluding a sales contract.
5.1 Alu Pro presents the Products for sale via the website available at www.apduro.pl. The presentation of the Products under the terms of the previous sentence does not constitute an offer within the meaning of the Civil Code and may be changed at any time.

5.2 The realization of Offers placed by the Customer follows the order of receipt of confirmed Offers for particular Products, until the stocks of a given Product type are exhausted. The quantitative stock of a given Product is specified on the Product card. Each Product within a Sales Campaign is subject to a separate Offer.

5.3 Sales Contracts are concluded in an electronic form, through the electronic form made available by Alu Pro in the Internet Shop, in such a way that:
(a) after selecting a Product presented by Alu Pro, in order to make an Offer the Customer goes to the Basket. At the first stage of placing an Offer, the selected Products visible in the Cart should be confirmed;
(b) after confirmation, the Customer automatically proceeds to the second stage "delivery", where he/she should provide the contact details for the delivery and issuance of a bill/VAT invoice, i.e. name, surname, address, telephone number and e-mail address, as well as choose one of the available delivery methods;
(c) once all the necessary fields have been correctly filled in, the Customer automatically proceeds to the "payment" stage, where he/she specifies the form of payment for the Product, choosing from among the available options.
(d) after completing the above steps, the Customer receives an e-mail confirming the receipt of the order by Alu Pro and indicating the date of its execution, which is equivalent to accepting the Offer and concluding the Sales Agreement for the selected Product. Failure to confirm the order means that the order has not been accepted for processing and thus the Sales Agreement has not been concluded.

5.4 The purchased Product is delivered through a courier company or the Polish Post, depending on the decision of the Customer, referred to in item 5.4. 5.4. b of the Regulations. Personal collection of the purchased Product is possible after prior telephone consultation and appointment.

5.5 In the case of choosing the Product delivery option through a courier company, the delivery rules are regulated in separate provisions. Delivery is made to the address indicated by the Customer in the order. The costs of transport and delivery of the Products are borne by the Customer. Information about the costs of delivery are given next to the Product presented in the Internet Shop.

5.6 In case of choosing the payment by bank transfer to the bank account of Alu Pro given on the website apduro.pl the Product is sent to the Customer after the payment is recorded. Failure to pay the Sales Price within one month from the conclusion of the Sales Agreement results in its termination.

5.7 If you run a company outside of Poland and you would like to receive 0% vat invoice please contact us via email before paying the order. We will prepare a proforma invoice for you for 0%. Complaints concerning this matter after the order has been paid will not be taken into consideration. 


6 Complaints / returns.

6.1 You and the Customer can make a complaint/return if and the goods do not meet their expectations.

6.2 In case of non-compliance of the Product with the Sales Agreement, the Customer has the rights specified in the provisions of the Act of 27.07.2002 on the special conditions of consumer sale and on the amendment to the Civil Code. The Client loses these rights if he does not notify Alu Pro about the discovered non-compliance of the Product with the Sales Agreement within 2 weeks from the date of discovering the Product's non-compliance with the Sales Agreement. Alu Pro is responsible for the incompatibility of the Product with the Sales Agreement only if it is found before 2 weeks from the release of the Product to the Customer. The warranty for the brand products is 2 years.

6.3 The Customer's complaint/return regarding non-compliance of the Product with the Sales Agreement should be submitted to Alu Pro via email to alupro.biuro@gmail.com or in writing to Alu Pro's registered office address: 12 Kazimierza Wielkiego St., 34-143 Lanckorona, and should specify at least:
(a) the Customer's details enabling the Customer to be contacted and identified as the Customer;
(b) the Customer's allegations;
(c) circumstances justifying the complaint;
(d) possibly suggested by the Customer method of removing the alleged non-compliance of the Product with the Sales Agreement.

6.4 Before making a complaint / return, the Customer is required to contact the following phone number Alu Pro +48 664 98 27 45. 

6.5 If the data or information provided in the complaint/return requires supplementation before the processing of the complaint, Alu Pro requests the Customer to supplement it in the indicated scope.

6.6 Alu Pro shall respond in writing/electronically to the complaint/return to the address provided by the Customer when submitting the Offer, within a period not exceeding 14 days from the date of receipt of the complaint in its correct form, indicating whether it accepts the complaint and how it intends to handle it, or informing of the lack of grounds for acceptance of the complaint together with the reasons for its position.

6.7 If Alu Pro accepts the complaint/return, depending on the manner of its settlement, an appropriate corrective invoice will be sent to the Customer to the address provided by the Customer when submitting the Offer. The Product purchased by the Customer will be refunded within 14 days from the date of confirmation of receipt of the corrective invoice by the Customer. If the purchase was made by a private person, then Alu pro's accountant will include this in the documentation, and the Customer will receive an e-mail confirmation. 


6.8. Pursuant to the Act of 02.03.2000 on the protection of certain consumer rights and liability for damage caused by dangerous products, the Customer may withdraw from the Product Sales Agreement without giving any reason within 14 calendar days from the date of receiving the Product. In order to effectively make a statement of withdrawal it is required to send a statement of withdrawal from the designated agreement within 14 days from the date of delivery of the Product in writing to the address alupro.biuro@gmail.com.


6.9 The Customer is obliged to return the goods to the address Alu Pro Andrzej Kowalczyk, Przytkowice 541, 34-141 Przytkowice.

The goods should be properly protected, preferably with Styrofoam, so as not to be damaged during transport. Shipping costs are covered by the customer, we do not accept shipments on delivery.


7 Personal data.
7.1 Personal Data Administrator is Alu Pro, which processes Personal Data in accordance with the law, in particular with the Act of August 29, 1997 on the Protection of Personal Data (consolidated text: Journal of Laws of 2002, No. 101, item. 926 as amended) and the Act of 18 July 2002 on electronic services (Journal of Laws No. 144, item. 1204 as amended).

7.2 Alu Pro processes Personal Data to the extent necessary to enter into, form the Sales Agreement, change, terminate and properly perform this agreement, make settlements with the Customer, for direct marketing of its own products, as well as for other purposes, provided that the relevant consents have been obtained.

7.3 Alu Pro is entitled to provide access to Personal Data only to entities authorized under applicable law, including the competent judicial authorities. Alu Pro shall not make Personal Data available to other entities, in particular to unauthorized persons, contrary to the law.

7.4 The Customer has the right to access the content of his/her Personal Data and the right to correct them, as well as the right to make a reasoned objection to their processing.


8 Final provisions.
8.1 Alu Pro reserves the right to amend the provisions of these Terms exclusively for important reasons (in particular dictated by technical and/or legal considerations), subject to Section 9.2 below.

8.2 If any changes are made to the Terms of Use, Alu Pro will inform Users about it by publishing the consolidated text of the Terms of Use on the website of the Online Store, and by sending the consolidated text of the Terms of Use via email to the email address provided by the User during the Registration process. Change in the Regulations comes into force within 7 days of sending the Regulations to the User.

8.3 The law applicable to the Agreements and Sales Agreements concluded under the Regulations shall be the Polish law.

8.4 In the case of change or invalidation as a result of a valid court decision of any of the provisions of the Regulations, the remaining provisions shall remain in force and be binding on Alu Pro and the Users.
